General conditions of sale

1. Subject matter

These conditions govern the distance sale, on the site https://bardsfx.com, digital music (unit tracks and packs) and custom compositions made by the seller identified below to any natural or legal person ("customer"). Making an order means accepting these conditions, in their online version on the day of the order.

2. Seller

Jean-Pierre Nottebaere, Entrepreneur individuel (micro-entreprise), SIRET XXXXXXXXXXXX, XXXXXX. Contact: contact@bardsfx.com.

3. Products

All the music is composed, arranged, performed and mixed by the composer, without resorting to a generative artificial intelligence at any stage.

Each music is presented with its universe, use, tempo, tone, duration and loop indication. A 15 seconds excerpt can be heard on the site. The files are delivered in WAV and MP3. The packs combine several tracks listed on their card.

Custom compositions are made from the description provided by the customer. The estimate posted on the site is indicative; a final estimate is sent by e-mail and must be accepted before any start of realization. Unless otherwise stated in the estimate, deux series of alterations are included.

4. Prices

Prices are shown in euros, all taxes included. TVA non applicable, article 293 B du Code général des impôts. The applicable price is that displayed at the time of the order, or that of the quotation accepted for a custom composition. No delivery costs are charged.

5. Command

The customer adds tracks or packs to his cart, indicates his email address, accepts these terms and conditions and the license to use, and requests immediate access to the files. He then validates his order with the "Order and Pay" button, which commits him to pay, then settles on the secure payment page.

When the online payment is temporarily unavailable, the order is registered and the customer receives by e-mail, within a period of 24 heures ouvréesa payment link.

The site is available in English, French and German. The contract is concluded in French; the translations of these conditions are provided for informational purposes and only the French version is authentic.

The contract is concluded at the time of validation of the payment. The seller may refuse an order for legitimate reasons, including an abnormal request or a previous dispute.

The seller confirms the order by e-mail, on a durable medium, at the latest at the time of delivery. This confirmation reflects the express agreement of the customer mentioned in Article 8.

6. Payment

Payment shall be made at once, by credit card or other means offered on the payment page, by Stripe Payments Europe, Ltd. The seller never has access to the customer's bank data. For custom compositions, payment shall be made according to the procedures specified in the estimate.

7. Delivery

Tracks and packages are delivered immediately after payment validation, in the customer's "My music" area, which opens automatically at the end of payment. The customer accesses it through a personal link sent by e-mail. From this space, he can listen to his music and download it, in WAV and MP3, without limit of number. The link is strictly personal: the customer undertakes not to share it. He can at any time request a new one, which disables the old one.

Access to the "My music" space is maintained as long as the site is operated. In case of closure, the customer is informed by e-mail at least thirty days in advance in order to download his files. It is recommended that a copy be kept.

Custom compositions are delivered in the same space within the time limit indicated in the estimate (for information: 1 semaines in standard time, 3 jours in express time).

In the event of delay in the delivery of a customised composition, the customer may, after ordering the seller to deliver within a reasonable additional time, terminate the contract under the conditions of articles L216-6 et seq. of the Consumer Code.

8. Right of withdrawal

The consumer customer normally has 14 days to withdraw from a distance contract (Article L221-18 of the Consumer Code).

Exception for digital files. In accordance with Article L221-28 13° of the Consumer Code, the right of withdrawal may not be exercised in respect of digital content supplied without material support, the execution of which began after the consumer's express prior consent and express waiver of his right of withdrawal.

When ordering, the customer expressly requests access to the files as soon as payment is made and acknowledges the loss of his right of withdrawal once this access has been provided. This agreement is confirmed by e-mail.

Customised compositions. A composition made according to the customer's specifications is clearly personalized: the right of withdrawal does not apply once the quote is accepted and the realization started (article L221-28 3° and 13°). The customer may, however, retract until the realization has begun.

To exercise its right when it applies, the customer sends a clear statement to contact@bardsfx.com, e.g. using the form below. The refund shall be made not later than 14 days after receipt of the request by the means of payment used.

9. Legal guarantee of conformity

The consumer customer benefits from the legal guarantee of conformity of digital content provided for in articles L224-25-1 et seq. of the Consumer Code. It has two years from the provision of digital content to implement it.

In the event of a lack of conformity (unreadable file, incomplete, not corresponding to its description), the customer can obtain compliance of the content free of charge. Failing this, he may obtain a price reduction or the resolution of the contract with full reimbursement.

10. User license

The purchase grants a license to use and not ownership of the works. Its conditions appear on the page User licensewhich forms an integral part of these conditions.

11. Liability

The seller is not responsible for the non-performance due to the customer, a third party or a case of force majeure. It is up to the client to keep a copy of the downloaded files; the access link to its space can be returned to it upon request.

12. Personal data

Data collected during an order or request are processed according to the privacy policy.

13. Claims and mediation

In the event of a dispute, the customer shall first address a written complaint to contact@bardsfx.com. In the absence of an amicable solution within one month, the consumer customer may use the following consumer mediator free of charge (articles L612-1 et seq. of the Consumer Code):

14. Professional customers

Articles 8 (withdrawal) and 9 (legal guarantee of compliance of digital content) apply only to consumers. Professional clients benefit from the guarantees of ordinary law.

15. Applicable law

These conditions are subject to French law. The consumer may, at his choice, refer the matter to the court where he remained at the time of the conclusion of the contract or of the occurrence of the harmful event, or any other court competent under the Code of Civil Procedure.
